Alleged treason: Sowore's case is delayed by the judge's absence
Due to the judge's absence, the Federal Government's case of suspected treason against Omoyele Sowore, a former African Action Congress presidential candidate, was put on hold on Tuesday in the Federal High Court in Abuja.


Sowore is accused of treasonable felony and is currently on trial before Justice Emeka Nwite.


According to the News Agency of Nigeria (NAN), on August 5, 2019, Sowore called for a protest with the hashtag #RevolutionNow. Shortly after, the government charged him of treason.


On Tuesday, Sowore appeared in court, but nothing further could be spoken.


The court registrar had notified his attorney, Mr. Marshall Abubakar, that the judge was on a national assignment in a different court jurisdiction, as he explained to NAN.


According to Abubakar, a new hearing date of February 14, 2024, must be set.


NAN remembers that during the most recent adjourned date of November 15, Justice Nwite had threatened to dismiss the case after four years if the government did not follow a court order to serve the second defendant with the charges.


However, Ms. Mariam Okorie, the prosecution attorney, stated that she was unsure if Olawale Bakare, the second defendant, had received the notice.


Sowore's attorney, Abubakar, had informed the court that the prosecution's inability to serve the second defendant with a hearing notice requiring him to appear in court was merely an attempt to irritate his client.


In order to allow Sowore to enter a plea and stand trial alone, Abubakar claimed to have written a letter to the Minister of Justice and the Attorney-General of the Federation requesting that the case be dropped.


The prosecutor further informed the court that they would have to wait for the minister's response to determine the next course of action because they had written to the minister.


At the time, Justice Nwite had stated that he would be willing to postpone the case if the prosecution agreed to serve the second defendant in accordance with the court's order by the next postponed date.


The judge had issued a warning, saying that the case would be dismissed if the court's order to serve the second defendant was not followed.
