The court has deferred ruling in the Rivers guber appeal.
The Supreme Court has deferred judgment in the appeal lodged by the All Progressives Congress (APC) candidate, Patrick Tonye-Cole, challenging Governor Siminalayi Fubara's victory in the March 18, 2023 gubernatorial election in Rivers State. 


This follows the Appeal Court's November 28 decision, which dismissed Tonye-Cole's appeal due to insufficient and unconvincing evidence. 


The appeal is based on allegations of Electoral Act non-compliance and Fubara's purported 'continued signing of documents as Accountant-General' after his nomination as the Peoples Democratic Party (PDP) gubernatorial candidate. 


The five-member panel, led by Justice Kudirat Kekere-Ekun, reserved judgment after all parties adopted their arguments. 


Meanwhile, Senators Napoleon Bali and Simon Mwadkwon expressed relief at the Supreme Court's decision reinstating Governor Mutfwang, challenging what they deemed an 'unjust judgment' by the Appeal Court and indicating their resolve to test constitutional provisions in light of the Supreme Court's ruling on the appellate court's jurisdiction.
